These terms govern use of our website and purchases made through it. Please read them before ordering and retain a copy for your records.
Our Delivery Policy, Payment Policy and Returns Policy also apply to purchases where relevant. Promotional offers, vouchers, product testing and collaborations may have additional terms, which will be made available where applicable.
Nothing in these terms or our policies excludes or limits your statutory rights. If a policy conflicts with these terms, your statutory rights take priority.
Separately agreed written trade terms apply to business purchases where specified. A business customer is a person purchasing wholly or mainly for purposes connected with their trade, business, craft or profession.
1. Online store terms
To place an order, you must be aged 18 or over and authorised to use the payment method provided. Where you order on behalf of a business, you confirm that you have authority to bind that business.
You must use our website and products lawfully. You must not introduce viruses, malicious software or other material intended to damage, disrupt or gain unauthorised access to our website or systems.
We may restrict access where reasonably necessary to address fraud, unlawful activity, security threats or a material breach of these terms.
2. General terms and website content
Unless otherwise stated, we own or hold the necessary rights to the text, photographs, videos, graphics, branding and other content on this website.
You may view, download and print content for your personal use or internal purchasing decisions. You must not copy, reproduce, sell, distribute or commercially exploit our content without our prior written permission, except where permitted by law.
You must not falsely imply that you are authorised by, affiliated with or endorsed by Bed-Down.
We may refuse an order before acceptance for a legitimate reason, including unavailable stock, failed payment, suspected fraud or delivery restrictions. Our rights concerning orders already accepted are explained below.
3. Accuracy and website information
We take reasonable care to keep product descriptions, prices and other purchasing information accurate and current. If we identify a material error affecting your order, we will deal with it under Section 11.
General articles, guides and other educational content provide information rather than advice tailored to an individual animal or situation. Where appropriate, obtain advice from a suitably qualified professional.
General website guidance does not replace product instructions or specific information we have agreed with you about a purchase.
Nothing in this section excludes our responsibility for information about our products that forms part of your contract.
4. Prices, payment and changes to our service
Consumer prices include VAT where applicable, unless clearly stated otherwise. Delivery charges and any other compulsory charges will be shown before you place your order.
Available payment methods are displayed at checkout. Unless otherwise agreed, payment is required when you place your order. Taking payment does not, by itself, mean we have accepted your order.
We may change prices, withdraw products or amend website services for future orders. These changes will not alter an order we have already accepted without your agreement, except where the law permits otherwise.
If we cannot accept an order for which payment has been taken, we will notify you and refund the payment without undue delay.
If an amount properly due under an accepted order remains unpaid, we may suspend dispatch while we contact you to resolve the issue. We will give reasonable notice and an opportunity to pay before cancelling for non-payment.
5. Products, descriptions and appropriate use
The product description and selected option identify what you are buying, including the pack size, quantity and stated weight or volume. Please check these details before ordering, as different purchasing options may contain different bale sizes or quantities.
Images illustrate our products. Packaging designs may change, and screen settings may affect how colours appear. Any packaging change will not materially alter the product you have ordered.
Our bedding contains natural materials. Reasonable variations in colour, texture, fragrance and appearance may occur between batches. Such variations do not, by themselves, mean a product is faulty, provided it meets its description and the standards required by law.
Product performance may vary according to factors such as the animal, stable conditions, ventilation, bed depth, management and storage. Any specific performance claims remain subject to the conditions and qualifications stated with them.
Please follow the product’s intended use and any storage, handling or application instructions supplied. If you require a product for a particular purpose that is not clear from its description, contact us before purchasing.
We are not responsible for loss or deterioration to the extent it is caused by inappropriate storage, misuse, contamination after delivery or failure to follow reasonable instructions. This does not affect responsibility for an existing fault or a problem caused by us.
Products supplied to consumers must be of satisfactory quality, fit for any particular purpose made known to and accepted by us, and as described.
We may limit quantities or discontinue products before accepting an order. We will not substitute a materially different product without your agreement.
6. Orders, acceptance and customer information
Please check your product selection, pack size, quantity, contact information and delivery address before submitting your order.
Submitting an order is an offer to purchase. An automated order acknowledgement confirms receipt of your order; it is not acceptance.
We accept your order when we send an email expressly confirming acceptance or dispatch the goods, whichever occurs first. A contract is formed at that point.
Before acceptance, we may decline an order because:
- The product is unavailable.
- Payment cannot be authorised.
- There is a material pricing or description error.
- We reasonably suspect fraud or unlawful activity.
- The delivery address falls outside the service available.
- The order exceeds a quantity restriction clearly communicated before purchase.
If we decline your order, we will notify you and refund any payment taken for it.
You must provide accurate and complete information and tell us promptly if it changes. If you discover an error after ordering, contact us immediately. We will make reasonable efforts to help, but changes may not be possible once an order has been processed or dispatched.
Where an error you have made causes additional delivery or collection costs, we may seek recovery only where the charge is lawful, reasonable, directly attributable to that error and appropriately disclosed or agreed. This does not apply where the error is ours.
7. Optional tools and external services
Our website may provide access to tools or services operated by third parties. Any separate terms governing those services will apply to your use of them.
We do not control independently operated third-party services and cannot guarantee their ongoing availability. Please review relevant terms before using them.
This does not exclude our responsibility for our own actions or for third parties carrying out obligations on our behalf under your purchase contract.
8. Third-party links
Links to other websites are provided for convenience and do not necessarily constitute an endorsement.
We do not control the content, availability or privacy practices of independently operated websites. Please review their terms and policies before providing information or purchasing from them.
If you purchase directly from another seller, your contract will normally be with that seller. Where your purchase contract is with Bed-Down, we remain responsible for our obligations under it.
9. Reviews, comments and submissions
You are responsible for ensuring that reviews, comments, photographs and other material you submit are lawful, accurate where presented as fact, and do not infringe another person’s rights.
You must not submit misleading reviews, impersonate another person or publish abusive, discriminatory, defamatory or unlawful material.
You retain ownership of your submissions. When you submit material specifically for public display on our website, you give us a non-exclusive, royalty-free permission to reproduce, display and reasonably format it for that purpose. This does not transfer ownership to us.
We will obtain any additional permission required before using private correspondence or customer images in advertising.
We may remove submissions that breach these terms, disclose personal information, contain spam or are otherwise unlawful. We will not alter a review to misrepresent its meaning.
Sending unsolicited ideas or suggestions does not create an obligation for us to use them or pay for them. Any commercial or confidential arrangement must be separately agreed.
10. Personal information
We handle personal information in accordance with our Privacy Policy and applicable data protection law.
Information necessary to process an order may be shared with payment providers, delivery companies and other service providers as explained in that policy.
Please do not send payment card details by ordinary email.
11. Errors, inaccuracies and omissions
Occasionally, an error may appear in a price, product description, promotion, delivery charge or availability statement.
If we identify a material error before accepting your order, we will contact you with the correct information and give you the choice of proceeding on that basis or cancelling for a refund. If we cannot reach you after reasonable attempts, we may decline the order and refund any payment taken.
Once an order has been accepted, we will not impose a higher price or materially change the product without your agreement.
Where an accepted order contains an obvious and unmistakable pricing error that you could reasonably have recognised as an error, we may cancel where legally entitled to do so. We will explain the issue and refund any payment taken.
We may correct website information for future orders at any time.
12. Prohibited uses
You must not use our website or services to:
- Commit fraud or carry out unlawful activity.
- Infringe intellectual property, privacy or other legal rights.
- Harass, threaten, abuse or discriminate against another person.
- Submit deliberately false or misleading information.
- Upload malicious code or interfere with website security.
- Obtain unauthorised access to accounts, systems or data.
- Collect personal information without a lawful basis.
- Send spam or conduct phishing or similar activity.
- Disrupt the website or prevent others from using it.
We may take proportionate action to prevent or address these activities, including restricting access and reporting suspected offences where appropriate.
13. Responsibility and limits of liability
We do not guarantee that the website will always be available or free from technical errors. We may temporarily suspend access for maintenance, security or other reasonable operational purposes.
For consumer purchases, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to exercise reasonable care and skill. Loss is foreseeable where it is an obvious consequence or was contemplated by both parties when the contract was made.
We are not responsible for loss that is not foreseeable, or for loss caused by your actions to the extent that we are not at fault.
For products supplied for private use, we do not accept liability for business losses arising from their use, including loss of business profit, business revenue or business opportunity.
Nothing in these terms excludes or limits liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Breach of statutory rights that cannot lawfully be excluded.
- Liability under applicable product liability legislation.
- Any other liability that cannot lawfully be excluded or limited.
Your use of a product does not remove your rights concerning an existing fault.
14. Responsibility for misuse
You are responsible for your own unlawful use of the website or deliberate infringement of our rights.
Where your breach of these terms causes us loss, we may pursue recovery through the remedies available under applicable law. We will not require you to cover losses caused by our own breach, negligence or unlawful conduct.
There is no automatic obligation for consumers to reimburse all claims, expenses or legal costs made against us.
15. Delivery and events outside our reasonable control
Our Delivery Policy and the delivery information supplied before purchase explain the arrangements applicable to your order.
You must tell us about relevant access restrictions and meet any delivery or unloading requirements clearly explained before ordering.
Any charge for a failed delivery or repeat delivery must be lawful, reasonable and appropriately disclosed or agreed. We will not charge you for a failure caused by us or our delivery provider.
For consumer orders, goods remain at our risk until they come into your physical possession or that of a person you nominate to receive them. Different rules may apply where you independently commission a carrier not offered by us.
If an event outside our reasonable control affects delivery, we will contact you as soon as reasonably possible and take reasonable steps to minimise the effect.
Such an event does not give us an unlimited right to delay performance or retain payment for goods we cannot supply. Your statutory cancellation and refund rights remain available.
16. Cancellation, returns and suspension
Cancellation, returns and exchanges are addressed in our separate Returns Policy, subject always to your statutory rights.
Consumers buying online generally have a statutory right to cancel from placing the order until 14 days after delivery, with a further 14 days to return goods after notifying cancellation, subject to applicable legal exceptions.
Responsibility for return transport costs, including pallet collections, must be explained before purchase where we intend those costs to be paid by the customer. For goods that cannot normally be returned by post, we will provide the required return-cost information before you order.
We may suspend website access for a material breach of these terms. Suspending access does not automatically cancel an accepted order or remove rights relating to purchases already made.
We may end an accepted contract for a material breach where legally entitled to do so. Where the breach can reasonably be put right, we will normally give notice and a reasonable opportunity to resolve it first.
17. Agreement and interpretation
These terms, the information forming part of your order and any expressly agreed additional terms govern the contract between you and Bed-Down T/A Marvellous Mulch.
Nothing in these terms excludes responsibility for a statement or representation where excluding it would be unlawful.
If a consumer term could have different meanings, the interpretation most favourable to the consumer will apply as required by law.
If a provision is found unlawful or unenforceable, the remaining provisions will continue to apply so far as they can operate lawfully.
A delay in enforcing a right does not mean that right has been waived.
18. Governing law and disputes
These terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain the protection of mandatory laws applicable where you live. You may bring proceedings in the courts of the UK country in which you live, where permitted by law.
For business customers, the courts of England and Wales have exclusive jurisdiction unless otherwise agreed in writing.
Please contact us first if you have a concern so we can try to resolve it.
19. Changes to these terms
We may update these terms to reflect changes to our business, website services or legal requirements.
The version made available when you place your order will apply to that order. Later updates will not retrospectively change an existing contract unless we agree with you or a change is required by law.
Updated website-use terms apply to future use once published. Any material changes will be brought to users’ attention where appropriate.
